Since Congress doesn’t want to read the Health Care Bill and Obama, ACORN, Unions, Lawyers, & Special Interest Groups don’t want you to know whats in this monstrosity, I decided to do it myself. Update: Folks, I’ve done this analysis and provided the fruit of my efforts here for free. I want all of you who read this to share it with as many people as possible. I’ve now come across sites that have advertising or services that generate income. No biggie, I love capitalism, but some have been using my work as their own. Pg 77
“(E) MEMBERS OF THE ARMED FORCES AND DEPENDENTS (INCLUDING TRICARE).—Coverage under chapter 55 of title 10, United States Code, including similar coverage furnished under section 1781 of title 38 of such Code.”
So it looks like TRICARE is being brought into the Govt Run Health Insurance Exchange.
We then find confirmation of this in ‘‘SEC. 59B. TAX ON INDIVIDUALS WITHOUT ACCEPTABLE HEALTH CARE COVERAGE.
The government tells us that Americans will be penalized with a tax if they don't have a acceptable coverage in one of the Qualified Benefit Health Plans the Govt Run Health Care Exchange lists. And you guessed it TRICARE is one of those plans as shown on pg 172:
‘‘(E) MEMBERS OF THE ARMED FORCES AND DEPENDENTS (INCLUDING TRICARE).— Coverage under chapter 55 of title 10, United States Code, including similar coverage furnished under section 1781 of title 38 of such Code.”

Sorry I didn't get back sooner to you. Professor William Jacobsen points to how HR 3200 will prevent anyone from seeking and obtaining medical services outside of their insurance:
“section 401(b) (at pp. 175-176). The following information must be reported by the person providing health coverage:
(A) the name, address, and TIN of the primary insured and the name of each other individual obtaining coverage under the policy, (B) the period for which each such individual was provided with the coverage referred to in subsection (a), and (C) such other information as the Secretary may require.
This information is to be provided to the IRS for good reason. The House bill provides for a tax on people who do not have acceptable coverage at “any time” during the tax year. House bill section 401 provides for a new section 59B (at pp. 167-168) of the Internal Revenue Code:
(a) TAX IMPOSED.—In the case of any individual who does not meet the requirements of subsection (d) at any time during the taxable year, there is hereby imposed a tax equal to 2.5 percent of the excess of—
(1) the taxpayer’s modified adjusted gross income for the taxable year, over
(2) the amount of gross income specified in section 6012(a)(1) with respect to the taxpayer.”

This prohibits individuals to change health plans both within their current plans or choosing a different insurance company after the bill goes into effect. I have told so many people about this recently, and they are apalled. They feel that Obama has been lying to them about the freedom to choose their insurance plan…and their right!

It is true that trying to push through a bill this quickly is risky; has the potential to be costly; and may alter some policies on health care. However, without changes to the current system there will only be 2 kinds of health care in the future = Care for the Rich and None for everyone else, because without some sort of regulation the ever rising cost of care is going to far surpass many of the insurance programs we currently have. Even with insurance there are no guarantees.
The medical industry has had little focus throughout this debate and is the industry we need most to focus on.
Dr. Eva Mor is quoted as saying, “The administration of the existing health delivery system is bloated with waste and unnecessary cost. If information was shared by all providers of health services and all insurers by using computerized systems to store all medical records, it would cut costs and reduce errors that would save and improve lives.
What we need in a health system is uniformity in pricing for procedures and services and modalities of provision of testing and procedures for diagnosis and treatment. By providing coverage to the uninsured, which initially will cost the taxpayer, it eventually will save us hundreds of millions of dollars.”

The Government has no business running health care for this country. Having health insurance does not make you healthy. The reason it costs so much is that for years, people with insurance nickeled and dimed the insurance companies to death. Every sniffle, every headache, every cough -go to the Dr. because it only costs $10.00. I only go to the Dr. if I really need to! If you have the flu you don't need to go to the Dr. All you need to do is stay in bed for a couple days and you will get better! Same with a cold. It just has to run it's course! If something needs to be done it should be directed to the Hospitals and Drug Companies who overcharge for medication and hospital stays. No way Tylenol is $50.00 a bottle! Or a box of kleenex is $30.00! My Mom has Cancer and was told recently because of Medicare her prescriptions were not covered. She would have to pay $900.00 a month for 1 prescription that is helping keep her alive! She is only 65 years old and it seems like the Government just wants her to die! I'm terrified of getting older because of what is going on! I'm 36 and would like to live a nice long life, but the Government does not want me to. If this Health Care plan is so great, why don't they want it for themselves? It will not apply to anyone in the Senate, Congress, House or the President. This is a Government take-over plain and simple! They are trying to control our lives and we'll end up like Russia! I don't think so! This is not the America our founding father's wanted! We are supposed to be able to make as much money as we want to because this is the Land of Opportunity! Not any more! If you make what they think is too much money – you will be punnished for it! WTF!!! Why are we allowing this to happen? We need to stop handing out free stuff to people because they will not get off their lazy butts, get an education and a job! It is not the Governments place to provide people with anything! This country was started by hard working people who wanted a better life and now it's filled with lazy good-for-nothings who just want a hand-out! This is not what America was supposed to be! I think it's sad! How much more of this will the decent, hard-working people of this country take before we rise up and overthrow the Government? It might be sooner than anyone thinks!!!

You are really UNINFORMED! And you do NOT know how the medical/health care industry currently works! Examples: 1) National Health Service Corps has a lengthy history of providing health care to underserved areas of the US. Some docs/nurses enroll in exchange for forgiveness of some of educational expenses. I was a doc in rural Vermont just because I was interested. My pay was $23,000 per year. I loved it; so did my patients! NHSC is part of the Public Health Service which has a 200-year history of providing services, especially to mariners (commercial fishermen, US Maritime Service, Coast Guard, US Navy)! USPHS is a uniformed service created by Pres John Adams and officers hold rank parallel with the US Navy. 2) Re page 801 “rationing” [sic]: Medicaid already exists and does not pay for a number of procedures, eg., abortion, cosmetic surgery. And this page simply says Medicaid funds can't be used to pay for complications from such procedures. This is ALREADY the case. So STOP the FEAR-MONGERING!

OK, I read through the first post, and your highly philosophical (ie detached, academic, nearly useless) analysis of “what kind of bill” the health-care bill is based on sweeping legal analysis based on word counts of “such”, and you demonstrate no sense of historical regulatory context. This is very troubling.
You've got to deepen your own education my friend. Just a small example: the federal government, through the USDA, the FDA, the EPA, and a host of other important regulatory institutions, sets out standards of doing business for food producers, and polluting industrialists. These laws have been protecting consumer health and safety for decades. Before the meat industry was regulated by the USDA in the 1920s for instance (“grade A”, etc), you might be sick in bed right now from last night's rotten steak. Yet you seem to take this underlying purpose for granted. It is the same purpose with health care. If people need health insurance in order to avoid getting gouged by the hospitals when they get sick (and this happens all the time), then the government is attempting to ensure that people do not get gouged by insurance companies as well — so people have somewhere to turn for affordable health services.
Fellow readers, do you trust “fact” check or Fleck's “smack” check? Are you going to be duped by this snarky fear-monger? You live in fear, Peter. And you resonate with others who live in fear. You are not here to solve problems. You are here to make noise. Your arguments fixate on the paranoia of government mandating this or that item, but you never grapple with the core of the issue, the multi-faceted purpose of why we need health care reform in this country.
If the government were really out to get you and to expand its dominion for its own sake, why would it even be responding to our need to reign in this 20-year hyperinflation in health insurance premiums? Why would government even care? Don't you see Obama tackling a legitimate problem that has needed to be addressed? Aren't you proud that some steps are FINALLY being taken?
Instead of complaining, why not obsess with innovative ways to bring costs down through regulations or a new health services business model?

Yeah the federal government is great. They've done fantastic work in establishing the US as the most obese country in the world. In fact more children have diabetes now and at an increasingly young age that at any time in American history. Have u visited a school cafeteria lately? There's nutrition prevention in a room and it's being fed to our kids every day. Breakfast and lunch.
FDA? You mean the government agency that's gone overboard in regulation? The agency that has prevented drugs that have been used in other countries for decades successfully? The agency, that as a result of it's over-regulation has increased cost for research & development and thus exponentially exploded the cost of drugs for Americans?
You want to talk about the rising costs of health care in America and the cause? Let's do so then. Let's point to the fact that costs have risen since the passage of Medicare which has $39 Trillion in unfunded debt. Let's continue with the HMO Act of 1973 that accelerated individual health care costs exponentially. Let's add to it the burden of defensive medicine which represents between 9% and 25% of the total health care spend in America today.

protected our health and safety. And then you countered me by blaming the

I'm sidestepping nothing. I'm pointing out the difference between stupid overbearing government regulation and smart regulation.
The solution articles I provided included links from Doctors, Businessmen, etc. who have actually run businesses and provided health care. These are people who have proven how to reduce health care costs with out the need for ObamaCare. You should probably read the citations thoroughly and study them. As for the CBO I have read the reports thoroughly. Perhaps if you did you would realize the following:
- The CBO scores only what Congress gives them to score and CBO only scores how Congress tells them to score it. They are static scores.
- The CBO scores on ObamaCare leave out the discretionary spending. That represents 40% to 60% of the cost of ObamaCare.
- The CBO states in their scores of ObamaCare that they are preliminary and are uncertain.
Additionally, I don't need to hook up with Lawrence Lessig to see the unending flow of corporate and union money flowing in to call the shots – I merely have to look at the largest recipient of that money right here:

As a Canadian I'm completely shocked as I read this low brow oversimplification. How you even managed to put together a blog is beyond me because the reading comprehension expressed here is abysmal.
You have taken every possible misinterpretation of fact (and rest assured, you are severely distorting reality here) and put them forward as misinformation.
There isn't a single soul with a clear mind about this matter who hasn't read this and been convinced that your position on this is compromised by ignorance or greed.

I agree that this “OBAMINABILL” is HORRIBLE! Typical liberals (w/ messiah complexes) tricks: create a crisis (notice how the number of uninsured got bigger & bigger & BIGGER – very inflated, & they NEVER ONCE determined how many were eligible for EXISTING benefits, which, believe me, were the vast majority of those that are here legally) then swoop in & “save” we lowly / helpless citizens from the primarily fake “crisis”. I think this reform of healthcare will make healthcare much worse. This is a VERY SAD thing – that the country that has (soon to be “had”) the potential to have the very best healthcare in the entire world will soon be struggling under this half-baked rush to disaster to even provide mediocre care to the aging boomers & our progeny. I have no connection whatsoever to the FDA or medical device manufacturing. But I do at least know what post-market device surveillance is. Would you like a pacemaker or artificial joint that your doctor, the FDA, & the manufacturer DID NOT watch for problems?
Think about it – If Toyota made pacemakers & you had one implanted in your chest keeping your heart a-pumping & no-one watched it for problems or reported any problems to a central surveillance entity, & one day the stupid thing accelerated & wouldn't quit firing at 300 jolts per minute, do you think you'd live for more than about 24 hours before your heart gave out from beating that fast? (Believe me, you probably wouldn’t even be able to dial 911 with your heart beating that fast.) How do you think they could get in touch with all the people who had Toyota pacemakers if they didn’t have a database? How many hundreds or thousands of people with Toyota pacemakers do you think would die before Toyota VOLUNTARILY took their out-of-control pacemakers off the market?

I agree the FDA is sometimes overly cautious & sometimes inadequately so. Sometimes FDA is so over-stretched that they are insufficiently so, these days particularly when it comes to inspection & surveillance of foreign drug manufacturers (a whole ‘nother subject).
Healthcare Quality: Look around on http://www.ahrq.gov & see if you think there aren’t government people who know about healthcare quality. I think they do a very good job. As an experienced RN (Registered Nurse) & CPHQ (Certified Professional in Healthcare Quality) I ought to know. I also know there is never not room for improvement.
My point is this: Make sure you understand your subject before you post objections to it.
I think what I believe they did to seniors on Medicare Advantage should be prosecutable! I will be watching closely for care rationing, denials of efficacy-proven treatments, & delays in treatment. I think those are my greatest fears about the government taking over healthcare. In a nutshell- the quality of care will plummet & people will suffer & die because of that – in AMERICA no less! I will not be proud to be an American when that happens!
